Creating A Variety of Trust Instruments to Address Our Clients' Needs

We create a variety of trusts to address our clients' individual needs, based upon their personal circumstances.

  • Living Trusts: A living trust, also known as a revocable living trust, can help you avoid probate while still giving you control over your assets during your lifetime. With a living trust, you are generally both the trustee and the primary beneficiary of the trust. A living trust can help you manage your affairs, retain control and prevent unwanted parties from controlling your assets
  • Special Needs Trusts: A special needs trust can provide ongoing support for a loved one with mental disabilities or physical impairments. These trusts can provide financial support and a higher quality of life for a disabled child or family member. Properly done, the money you put in the trust, will not affect eligibility for Social Security Disability, Medicaid and other governmental benefits.
  • Miller Trusts: Many older people have too much income to qualify for governmental assistance programs such as Medicaid, but insufficient income to pay for nursing home care or other living assistance. A Miller Trust, also known as a Qualified Income Trust, is an irrevocable trust that can help you or a loved one qualify for financial assistance despite income above the legally established limit. We also offer other Medicaid planning strategies to prevent all of your hard-earned assets from being used to pay nursing home costs.
  • Charitable Remainder Trusts: A charitable remainder trust can allow you to support charitable causes, reduce your income taxes, and reduce your estate taxes, while still providing you with a source of income. Such trusts are often quite effective as part of a comprehensive estate tax planning.
  • Pet Trusts: Texas Law has recently been changed to allow individuals to remember their pets in their Wills through a trust. McCulloch and Associates can help you structure such a trust that will ensure the continued care of your beloved pet upon your death.
